1. General Information
These Terms & Conditions ("Terms") govern access to and use of the MTP-Exchange Marketplace, available at https://mtpexchange.com ("Platform").
The Platform is operated by China Africa Meaningful Tourism Partnership NPC (CAMTP), based in Century City, South Africa ("Platform Operator").
Postal Address: Postnet Suite 2029; Private Bag X2, Century City, 7446, South Africa.
Email: mtpexchange@camtp.net | Phone: +27 77 265 82 93
By accessing or using the Platform, users agree to comply with these Terms to the extent permitted by applicable law.
Additional contractual terms may apply to specific bookings, products, services, or business relationships.
2. Purpose and Nature of the Platform
MTP-Exchange is a digital marketplace and technology infrastructure connecting tourism service providers, destination management companies (DMCs), tour operators, travel agencies, distributors, and customers.
The Platform provides technological functionality for:
- Searching and discovering tourism products and services.
- Viewing product descriptions, prices, and availability.
- Making reservations and submitting booking requests.
- Facilitating online payment transactions through integrated payment service providers.
- Generating and delivering booking confirmations, vouchers, invoices, and other documents on behalf of the relevant sellers.
- Supporting communication and booking-related processes between the relevant parties.
The Platform Operator acts as a technology infrastructure provider and does not independently organize, sell, operate, or deliver the tourism services offered through the Platform.
3. Contractual Relationships
Tourism products and services available through the Platform are offered by independent sellers or service providers ("Sellers").
When a customer purchases or books a tourism product or service, the contractual relationship is established directly between the customer and the relevant Seller or other clearly identified contractual service provider.
The Platform Operator is not a party to the contract for the purchased tourism service.
The Seller is responsible for fulfilling the contractual obligations arising from the booking, including the accuracy of product information, service delivery, applicable booking conditions, and customer support relating to the purchased service.
The identity of the contractual Seller and the applicable booking conditions must be made available to the customer before the booking is completed.
Nothing in these Terms limits statutory consumer rights or mandatory legal obligations.
4. Product Information and Availability
Product descriptions, itineraries, images, prices, availability, inclusions, exclusions, and other service-related information are provided by the respective Sellers.
Sellers are responsible for ensuring that published information is accurate, complete, current, and legally compliant.
Availability and prices may change until a booking is confirmed.
The Platform Operator provides the technical infrastructure for displaying and processing this information but does not independently guarantee the accuracy or availability of third-party products.
5. Booking Process
Customers may select tourism products or services and submit reservations or booking requests through the Platform.
The booking process may include:
- Selection of the desired product or service.
- Selection of available dates, participants, and optional services.
- Review of the booking details and applicable conditions.
- Submission of the booking request and, where required, completion of payment.
- Confirmation of the booking by the relevant Seller.
The exact point at which a binding contract is concluded depends on the applicable Seller's booking conditions and mandatory law.
A payment transaction or automated acknowledgment does not necessarily constitute final confirmation of the requested service.
Once the booking is confirmed, the customer may receive a booking confirmation, voucher, invoice, or other relevant documentation issued by or on behalf of the Seller.
6. Payments
Payments for tourism products and services are processed through the payment service provider account of the relevant Seller or contractual merchant.
The Platform Operator does not receive, collect, or hold customer payments in its own accounts.
MTP-Exchange provides technical integration with external payment service providers to facilitate secure payment processing.
The Seller remains responsible for payment-related contractual obligations, including applicable taxes, invoicing, refunds, and chargebacks.
Payment methods, currencies, transaction fees, and processing conditions may vary depending on the Seller, the selected payment service provider, and the customer's location.
Payment transactions may also be subject to the terms and privacy policies of the relevant payment service provider.
7. Booking Confirmation and Travel Documents
Booking confirmations, vouchers, invoices, receipts, and other booking-related documents may be generated and delivered automatically using the Platform's technology.
Such documents are issued exclusively by or on behalf of the relevant Seller or contractual service provider.
The Platform Operator does not issue travel documents, invoices, or receipts in its own name for tourism services sold by independent Sellers.
Customers are responsible for reviewing the information contained in their booking documents and promptly reporting any discrepancies to the relevant Seller.
8. Cancellations, Changes, and Refunds
Cancellation, modification, and refund conditions are determined by the respective Seller and the applicable booking agreement, subject to mandatory consumer protection laws.
Before completing a booking, customers should review the applicable cancellation and modification conditions.
Requests for cancellations, changes, or refunds must be addressed to the relevant Seller or processed through the available Platform functionality on the Seller's behalf.
The Seller is responsible for determining and executing refunds in accordance with the applicable contractual conditions and legal requirements.
The Platform Operator provides the technical infrastructure for processing such requests but does not independently determine cancellation penalties or refund entitlements.
9. Responsibilities of Sellers
Sellers offering products or services through the Platform are responsible for:
- Maintaining accurate and current product information.
- Providing services in accordance with published descriptions and contractual commitments.
- Holding any licenses, registrations, permits, or insurance required by applicable law.
- Complying with applicable tourism, consumer protection, tax, and other relevant legislation.
- Handling customer inquiries, complaints, cancellations, and refunds relating to their services.
- Issuing legally required invoices and other customer documentation.
- Ensuring that payment processing is conducted through their own authorized payment service provider accounts.
Sellers may be subject to separate commercial agreements governing their participation in the MTP-Exchange network.
10. Responsibilities of Customers
Customers agree to:
- Provide accurate and complete information when making bookings.
- Review product descriptions, booking conditions, and payment details before completing a transaction.
- Ensure that travel documents, visas, permits, and other personal travel requirements are fulfilled where applicable.

- Use the Platform only for lawful purposes.
Customers must not use the Platform for fraudulent transactions, unauthorized access, automated abuse, or other unlawful activities.

Users are responsible for maintaining the confidentiality of their account credentials and for activities conducted through their accounts, to the extent permitted by applicable law.

12. Third-Party Services
The Platform may integrate external services, including payment providers, mapping services, communication services, and other technical systems.
These services may be subject to additional terms and conditions established by their respective providers.
The Platform Operator is not responsible for the independent contractual obligations of third-party providers, except where liability arises under applicable law.
13. Intellectual Property
The Platform's software, technical infrastructure, design, trademarks, and original content are protected by applicable intellectual property laws.
Users receive a limited, non-exclusive, non-transferable right to access and use the Platform for its intended purposes.
This right does not include permission to reproduce, reverse engineer, distribute, or commercially exploit protected Platform components except where permitted by applicable law or expressly authorized.
Product descriptions, photographs, trademarks, and other content provided by Sellers remain subject to the rights of their respective owners.
14. Platform Availability and Technical Operation
The Platform Operator endeavors to maintain reliable and secure operation of the Marketplace.
However, uninterrupted availability cannot be guaranteed.
Temporary interruptions may occur due to maintenance, software updates, technical failures, network disruptions, or circumstances outside the Platform Operator's reasonable control.
The Platform Operator may modify, improve, or update Platform functionality, provided that applicable contractual and statutory obligations are respected.
15. Liability
The Platform Operator is responsible for providing the technical infrastructure of the Marketplace in accordance with applicable law.
The Platform Operator does not assume responsibility for the performance, quality, safety, legality, or delivery of tourism services offered by independent Sellers.
Claims arising from the performance or non-performance of purchased tourism services must be directed to the relevant contractual Seller or service provider.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for intent, gross negligence, injury to life, body or health, or mandatory statutory obligations.
Where legally permitted, liability for minor negligence may be limited in accordance with applicable law, without prejudice to liability for the breach of essential contractual obligations.
